United States (Remote)EngagementIntellectual Property

IP Litigation Attorney

Job Description

Latitude Legal is seeking an experienced IP Litigation Attorney (7+ years) to support a San Francisco-based intellectual property and complex litigation firm on a fully remote, engagement (contract) basis. The role is part-time, with the expectation of flexing up to full-time during peak periods. The engagement is ongoing, with an expected duration of at least 4-6 months.

The firm tries complex patent and IP cases for technology clients and has multiple trials coming up, beginning with a patent case set for trial at the end of the year. With a trial team already in place, the firm is looking for a seasoned litigator to handle the pre-trial workload behind the scenes. Candidates who can travel to Northern California for trial may also have the opportunity to take on a more front-facing role (if preferred), including second-chair trial support. Beyond trial support, the role includes general IP litigation support, with potential additional work on additional trials on the firm's calendar.

What You'll Do Includes:

  • Draft and revise pre-trial motions and briefing in federal district court, including motions in limine, Daubert motions, and related oppositions
  • Research and draft pocket briefs on anticipated evidentiary, legal, and procedural issues
  • Build and manage the trial record: exhibit lists, exhibit binders, deposition designations and counter-designations, and objections to the other side's designations and exhibits.
  • Prepare witness examination materials, including outlines and cross-examination preparation for fact and expert witnesses, and take over cross-examinations where experience allows.
  • Work with technical and damages experts and consultants to prepare their testimony and support the trial team on expert-related issues.
  • Coordinate with the lead trial attorney and paralegal team to keep work moving against pre-trial deadlines.
  • Attend trial in Northern California, if interested and available, in a second-chair support capacity.
  • Provide general IP litigation support across the firm's docket as needed, including discovery, motion practice, and case strategy.
  • Support the firm's other complex trial matters as they approach pre-trial deadlines.

Who You Are:

  • Attorney with 7+ years of IP litigation experience, preferably patent litigation.
  • Strong motion practice and drafting skills, with experience preparing a case for trial, including motions in limine, exhibits and designations, and pretrial filings.
  • Trial experience preferred; experience preparing or conducting witness examinations, including cross-examination of experts, is a plus.
  • Experience working with technical and damages experts is a plus.
  • Comfortable working independently under tight deadlines while taking direction from a lead trial attorney.
  • Licensed to practice law and in good standing; California license preferred, but attorneys licensed in other states are encouraged to apply and will be considered for behind-the-scenes support.
  • Comfortable shifting between part-time and full-time hours as the trial schedule requires.
  • Able to take on this engagement without conflicts. Limited availability for other matters is ideal.
  • Available during Pacific business hours and comfortable working fully remotely.
  • J.D. from an accredited law school.
  • Outstanding references.
